A bicyclist is tragically dead following a serious accident in Las Vegas. Nevada police responded to the accident, which is being attributed to alleged drunk driving on the part of the driver involved. The collision occurred shortly after 11:30 on the night of June 26. The driver in question has been charged with DUI as well as hit and run.
The accident report is somewhat unclear. It has been confirmed that the vehicle involved struck a bicyclist at an intersection. The 40-year-old driver involved in the crash apparently fled the scene initially before turning himself in to police some time later.
It is unknown whether the bicyclist died on the scene or succumbed to injuries later. It is also unknown how police made the determination that the man was intoxicated at the time of the accident, as no mention was made of sobriety testing or blood tests being administered. No court date has been publicly announced in connection with this case.
Nevada prosecutors will have to prove that the man was intoxicated at the time of the accident in order for him to be convicted of drunk driving. If police did not administer tests to document the man’s intoxication or sobriety, or if they did so in a way inconsistent with the man’s rights, the charge could be brought into question. It may even be dismissed altogether if it is established that the man’s rights were in some way violated. The charge of hit and run may be tempered by the fact that the man apparently took the initiative to surrender to the authorities on his own.
