A former college basketball player is facing serious charges after his arrest early on the morning of Sept. 3, according to police. Nevada authorities have charged the man with drunk driving after he was pulled over. He is one of several players to be arrested for DUI over the last several months.

The details of the arrest were not included in this report, but it has been confirmed that he was pulled over around 1:51 a.m. and booked for drunk driving by attending officers. There was no mention of whether a roadside sobriety test was conducted at the time of the arrest. Police did not publicize the reasons why they believed the man was driving drunk.

He was booked into a county jail and held on $2,000 bond. As of this report, he is still in custody awaiting a trial date. No date has yet been publicized. As he is not a current player, the team has taken no action against him.

The burden of proof in a drunk driving case falls to Nevada prosecutors, who must prove beyond reasonable doubt that the man was indeed drunk at the time of his arrest. Defense may wish to review the facts of the case to determine whether the man’s rights were respected throughout the arrest process, and to determine if a roadside or other sobriety test was conducted. If such a test was not conducted, it may be possible to argue in favor of a reduction in sentence or even to have the charges dropped altogether.
